1. About TradeCaller

TradeCaller Ltd provides AI-powered receptionist services for trades and small businesses in the United Kingdom. Our service answers inbound calls on behalf of clients, collects caller information, and passes details to the client for follow-up. FinCaller is a trading name of TradeCaller Ltd, company number 17178836. All terms and conditions contained herein apply equally to FinCaller services.

2. Acceptance of Terms

By subscribing to TradeCaller or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

3. Subscribing to TradeCaller

By subscribing to TradeCaller you confirm that:

  • You are a business or sole trader based in the United Kingdom

  • You are authorised to enter into this agreement on behalf of your business

  • All information you provide during sign-up is accurate and up to date

  • You are at least 18 years of age

4. Services Included

Depending on your chosen plan, TradeCaller will provide:

  • A customised AI receptionist agent configured for your business

  • 24/7 inbound call handling via call forwarding from your existing number

  • Lead qualification and caller detail collection

  • Call summaries sent to you via SMS or email after each call

  • Access to call transcripts via the TradeCaller platform

5. Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete information necessary for TradeCaller to configure and deliver the service

  • Ensuring their existing phone number is set up correctly for call forwarding to TradeCaller

  • Ensuring they have the necessary rights and permissions to allow integration with any existing platforms or systems

  • Not using our services for any unlawful purpose or in any way that could harm TradeCaller Ltd or third parties

  • Ensuring their customers are informed that calls may be answered by an AI receptionist

6. Pricing and Payment

  • All prices are shown in GBP and are exclusive of VAT where applicable

  • Monthly plan: £99 per month, billed monthly in advance

  • Annual plan: £999 per year, billed annually in advance

  • Payment is taken automatically via Stripe on your billing date

  • There are no setup fees

  • There are no long-term contracts — you may cancel at any time

  • TradeCaller reserves the right to adjust pricing with 30 days written notice for existing subscription clients

7. Late Payment

Late or failed payments may result in temporary suspension of your service until payment is resolved. TradeCaller will attempt to notify you of any payment failure before suspending service. Persistent non-payment may result in termination of the subscription.

8. Cancellation

  • You may cancel your subscription at any time by contacting contact@tradecaller.co.uk

  • Cancellation takes effect at the end of your current billing period

  • No refunds are issued for partial months or partial years

  • Upon cancellation your agent will be deactivated and your data will be deleted within 30 days unless you request earlier deletion

9. Fair Use

TradeCaller operates on a fair use basis. If your call volume significantly exceeds what is reasonable for your plan, we reserve the right to contact you to discuss moving to a more appropriate arrangement.

10. Service Availability

TradeCaller will use reasonable efforts to maintain service availability at all times. However, we cannot guarantee 100% uptime as our service depends on third party providers including ElevenLabs and Twilio. We will notify clients of any planned maintenance or known outages as soon as reasonably possible.

11. Intellectual Property

TradeCaller Ltd retains ownership of all proprietary tools, agent configurations, prompt frameworks, methodologies, and systems used in delivering the service. Clients do not acquire any ownership rights over TradeCaller's technology or methods by virtue of subscribing.

Call data, transcripts, and information collected on behalf of the client during calls belongs to the client and will be returned or deleted upon request or at the end of the subscription.

TradeCaller reserves the right to reference clients in case studies, testimonials, or portfolio materials unless the client requests confidentiality in writing.

12. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of the engagement and not to disclose it to third parties without prior written consent, except where required by law. This obligation continues after the termination of the subscription.

13. Limitation of Liability

  • TradeCaller is not liable for any missed calls, lost leads, or business losses arising from service downtime or technical issues

  • TradeCaller is not liable for any errors made by the AI agent during calls, including incorrect information given to callers

  • We make no guarantees regarding specific business outcomes, revenue growth, or lead conversion rates resulting from our services

  • Our total liability to you in any 12 month period shall not exceed the total subscription fees paid by you in that period

14. Changes to the Service

TradeCaller reserves the right to update these terms, pricing, or the service at any time. We will give you at least 30 days notice of any material changes. Continued use of the service after that period constitutes acceptance of the new terms.

15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

DATA PROCESSING AGREEMENT

This Data Processing Agreement forms part of the Terms of Service between TradeCaller Ltd (the "Processor") and the subscribing business (the "Controller").

This agreement is entered into in accordance with Article 28 of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

1. Definitions

  • Controller: The client business that determines the purposes and means of processing personal data

  • Processor: TradeCaller Ltd, which processes personal data on behalf of the Controller

  • Personal Data: Any information relating to an identified or identifiable natural person collected during calls handled by TradeCaller

  • Data Subject: The individual caller whose personal data is collected during a call

2. Subject Matter and Purpose of Processing

TradeCaller processes personal data on behalf of the Controller for the following purpose:

  • Answering inbound telephone calls on behalf of the Controller's business

  • Collecting caller information including name, phone number, email address, location, and reason for calling

  • Passing collected information to the Controller via SMS, email, or other agreed method

  • Storing call transcripts for the duration of the retention period set out below

3. Types of Personal Data Processed

TradeCaller may process the following categories of personal data on behalf of the Controller:

  • Full name

  • Phone number

  • Email address

  • Home or business address and postcode

  • General location

  • Details of the caller's enquiry or requirements

  • Call transcripts and recordings

TradeCaller does not process any special category data unless explicitly agreed in writing.

4. TradeCaller's Obligations as Processor

TradeCaller agrees to:

  • Process personal data only on the documented instructions of the Controller

  • Ensure that all staff and systems with access to personal data are subject to appropriate confidentiality obligations

  • Keep confidential any sensitive business information shared by the Controller during the course of the engagement and not disclose it to third parties without prior written consent, except where required by law

  • Implement appropriate technical and organisational security measures to protect personal data

  • Not transfer personal data outside of the United Kingdom or European Economic Area without appropriate safeguards in place

  • Assist the Controller in responding to Data Subject requests within a reasonable timeframe

  • Delete or return all personal data to the Controller upon termination of the agreement within 30 days

  • Notify the Controller without undue delay if TradeCaller becomes aware of a personal data breach

  • Make available to the Controller all information necessary to demonstrate compliance with this agreement

  • Acknowledge that while TradeCaller takes all reasonable steps to ensure accurate data capture, the AI agent may occasionally mishear or incorrectly record caller information. TradeCaller accepts no liability for losses arising from inaccurate data capture by the AI agent.

5. Sub-Processors

The Controller agrees that TradeCaller may engage the following sub-processors to deliver the service:

  • ElevenLabs — AI voice agent platform. Data stored in the European Economic Area.

  • Twilio — Telephony provider handling call routing and SMS delivery. GDPR compliant. Note: SMS routing may pass through US servers under Standard Contractual Clauses.

  • Make.com — Automation platform processing call data and triggering notifications. EU-based servers.

  • Cal.com — Demo booking and scheduling. EU-based servers.

  • Stripe — Payment processing. GDPR compliant.

TradeCaller will inform the Controller of any intended changes to sub-processors and give the Controller the opportunity to object before any change takes effect.

6. Controller's Obligations

The Controller agrees to:

  • Ensure they have a lawful basis for collecting personal data from their callers

  • Ensure their callers are aware that calls may be answered by an AI receptionist and that their details will be collected and passed to the business

  • Not instruct TradeCaller to process personal data in any way that would violate UK GDPR or any other applicable law

  • Respond promptly to any Data Subject requests forwarded by TradeCaller

7. Data Retention

TradeCaller will retain call transcripts and collected caller data for a maximum of 90 days from the date of the call. After this period, data will be automatically deleted unless the Controller has requested earlier deletion or the data is required to be retained for legal reasons.

The Controller is responsible for storing any caller details they wish to retain beyond this period in their own systems.

8. Data Breach Notification

In the event of a personal data breach affecting the Controller's data, TradeCaller will notify the Controller within 72 hours of becoming aware of the breach, including:

  • A description of the nature of the breach

  • The categories and approximate number of data subjects affected

  • The likely consequences of the breach

  • Measures taken or proposed to address the breach

9. Audit Rights

The Controller has the right to request information from TradeCaller to demonstrate compliance with this agreement. TradeCaller will respond to reasonable audit requests within 30 days.

10. Duration

This Data Processing Agreement remains in force for the duration of the subscription and terminates automatically upon cancellation or expiry of the subscription.

ACCEPTANCE

By subscribing to TradeCaller and ticking the acceptance checkbox at checkout, the Controller confirms that they have read, understood, and agree to both the Terms of Service and the Data Processing Agreement set out above.
